Quy định thời gian nghỉ thai sản 2013

Theo  tôi biết rằng kể từ ngày 01/5/2013 thời gian sinh của lao động nữ là 6 tháng. Vậy cho tôi hỏi là nếu sinh con vào giữa tháng 3/2013, thì tôi có được nghỉ sau sinh 6 tháng hay không? Xin cảm ơn.

 

Điều 240 Bộ luật Lao động 2012 quy định Luật này có hiệu lực từ ngày 01 tháng 05 năm 2013. Đồng thời điểm b khoản 2 Điều 240 cũng quy định kể từ ngày Bộ luật này có hiệu lực thi hành:

“Quy định về thời gian hưởng chế độ khi sinh con tại Luật bảo hiểm xã hội số 71/2006/QH11 được thực hiện theo quy định của Bộ luật này.

Lao động nữ nghỉ sinh con trước ngày Bộ luật này có hiệu lực, mà đến ngày 01 tháng 5 năm 2013 vẫn đang trong thời gian nghỉ sinh con theo quy định tại Luật Bảo hiểm xã hội số 71/2006/QH11 thì thời gian hưởng chế độ khi sinh con được thực hiện theo quy định của Bộ luật này...”

Như vậy, theo như bạn trình bày, bạn sẽ nghỉ chế độ thai sản bắt đầu từ giữa tháng 3 năm 2013 và thời gian nghỉ chế độ thai sản của bạn theo Luật Bảo hiểm xã hội năm 2006 là 4 tháng, tức đến giữa tháng 7 năm 2013. Thời điểm này, Bộ luật Lao động năm 2012 đã có hiệu lực thi hành, nên áp dụng theo quy định mới bạn sẽ được nghỉ thêm 2 tháng nữa, tức thời gian nghỉ thai sản là 6 tháng.
